Governor Tina Totek just signed into law HB 2001 which doubles the time frame to evict a tenant. This means more risk and cost for landlords. Sadly this will only compound the lack of housing in Oregon and lead to stricter screening criteria and higher rents. Clearly Tina Kotek isn't serious about housing.

The Oregon legislature is looking at reducing the current rent cap from 7% plus CPI to 3% plus CPI. They are also looking at tripling statewide relocation to 3 months rent from 1 months rent. These policies will only harm the housing market.

    I have a property manager that handles my property, I received a 1099 misc from him but what do I give him to show his 10% services?

      This doesn't doesn't capture expenses, including the monthly management fee. It is only reporting gross income. Income that came to the property, whether it came to you or not. You use that income, along with your expense records to determine your taxable income.

      True, but it’s bad for the market and for Oregonians in the long run. We believe in doing what’s right for the overall market versus what may benefit our company otherwise we will remain in a housing crisis forever.

    this is my first year reporting rental income, as the landlord, I did not know I had to have a 1099 mis. So my question, can you guide me how to get a 1099 from the IRS. Do I have to hire an account or is it something I can do as I only have one property.

      We are unable to give tax advice, however if you are the owner and receiving the rents you do not need to 1099 yourself. We issue 1099-MISC forms because we handle trust money for our clients and have to report what we received on their behalf.

    It would be very helpful if the monthly owner statement example was not out of focus and enlarged so it would be easier to see and follow during the explanation.

      Hi Carola, thank you for your comment. We are not able to give legal advice. You would need to consult an attorney. With that said if you are in the city of Portland and you received less than 90 days, then they are likely not complying with the rules. If you are outside of Portland, a 60 day notice is allowed. I hope this helps.

    What happens if the tenant pre pays some rent in 2017 for 2018. Is that counted on 2017 or 2018?

      It depends on when the funds arrive in the client trust account. For example, if someone pays online and the transaction merely posts, but the funds do not arrive in 2017, then the funds would not be reported for 2017 income.

    There are many jurisdictions that do relocation stipends. Including portland for manufactured and floating homes. Many other components of this bill have been grossly misstated.

      +Margot Thank you for your comment. Manufactured homes and floating homes are viewed entirely separate under Oregon landlord-tenant law (ORS Chapter 90). The markets are very different and serve a much smaller demographic.There are currently no relocation funds required to be paid by residential or multifamily property owners. There is little doubt that an increased cost in operation will increase rents and discourage many small landlords from continuing to rent their homes. Would you be willing to elaborate on what has been "grossly misstated" as well as what expertise you have? Thank you!
